The Lake at a Glance

Lake Toxaway's story begins in 1903 when E.H. Jennings dammed the Toxaway River in what is now Transylvania County to create a private mountain resort lake. The original development attracted the most prominent families in American industry — the Fords, Edisons, Firestones, and Rockefellers built cottages and retreats on what was then a remote Appalachian lake accessible only after a considerable journey. The resort era ended abruptly in 1916 when sustained flooding caused the dam to fail catastrophically, sending over five billion gallons of water down Toxaway Falls into South Carolina and leaving the lakebed dry for more than four decades. The lake's resurrection came in 1960 when Reg Heinitsh and a group of investors reformed the Lake Toxaway Company, rebuilt the dam to modern standards, and began the second era of Lake Toxaway development — the one that continues today.

At 640 acres with 14 miles of shoreline, Lake Toxaway is North Carolina's largest privately held lake. It sits at 3,010 feet elevation, making it one of the highest significant lake communities in the eastern United States and giving it the cool summer climate that has always been its primary appeal for buyers escaping lowland heat. The lake maintains a constant pool level — it was designed purely as a recreational lake, not a reservoir or hydroelectric source, so there is no drawdown mandate, no flood-control authority drawing the lake down in fall, and no seasonal variance in water level. The pool today is the pool year-round, every year.

What Buyers Need to Know First

Lake Toxaway is a private gated community governed in its entirety by the Lake Toxaway Company. There are no public boat ramps, no public access points, and no mechanism for a non-member to access the lake. All shoreline development, dock permitting, architectural modifications, and vegetation management on the lake side of properties falls under Lake Toxaway Company governance rather than any utility, federal agency, or county permitting authority. This is fundamentally different from Duke Energy lakes, TVA lakes, or Army Corps lakes — there is no FERC license, no shoreline management plan filed with a federal agency, no Section 26a permit process. The Lake Toxaway Company sets the rules, and membership in the Company is a prerequisite for property ownership in the community. Buyers should request and thoroughly review the Lake Toxaway Company governing documents, covenants, dues schedule, and architectural review standards before making an offer on any property in the community.
